District Attorney Defines Hate Crime

       Chico resident Brian Denham is still shaken and recovering after he was assaulted outside the Jack in the Box on Broadway. Denham and several friends were coming from the Maltese Bar and Tap Room after a drag show last Friday night, two of his friends were still dressed in drag when a group of men started yelling anti-gay slurs at the group. " They were waiting for us outside, they started yelling at us and from there things just escaladed," explained Denham. 
     Denham stuck up for his friend's, and that's when he was hit. Denham says, " Someone sucker punched me when I had my back turned, took off running after him, I fell and someone jumped on the back of my head." Denham was taken to Enloe Medical Center, and treated for an orbital fracture above his eye, and a head wound. Many are calling the assault a hate crime. " They were throwing hate around like water balloons," said Matthew Cottrell, a friend of Denham.
     But Butte County District Attorney Mike Ramsey says hate crimes can be hard to prove. " We have to prove that inside this person's hate filled noggin, it was because of a person's perceived class that this crime occurred," explained Ramsey.   
     Ramsey says hate crimes must show a motive. He also says the fact that Denham was not dressed in drag may make it harder to classify the attack as a hate crime. " That certainly could change the dynamic, if the person that stood up for them is not of the protected class, or the suspects did not believe that they were part of the protected class, then it's an ordinary crime," said Ramsey.

First off, let me say that I am a 68 year old heterosexual, but I would like to know how could this be classified as anything BUT a hate crime? The attackers began by shouting anti-gay remarks, and a person was injured BECAUSE he was with two drag queens..Sounds to me pretty cut and dried. The attackers should be prosecuted to the fullest extent of the law for this HATE CRIME.

Rasey is an idiot and should have been voted out of office long ago. Shots were fired in his home within Oroville city limits during a domestic spat, his daughter tried to run somebody over in her truck and we still keep voting this arrogant jerk back into office. enough is enough lets vote this Ahole out of office.

BRIAN DENHAM- OPENLY GAY MICHAEL AVERY-OPENLY GAY MATTHEW COTTRELL-OPENLY GAY SARAH COX-OPENLY BISEXUAL RICHARD SHELBY-DUNN- OPENLY GAY. And Mr DA i dunno if you were too busy just looking for excuses but in the CA PENAL CODE SEC. 422.55 (under definitions)  sub sec a it lists the "actual or precived characteristics of the victim"  "(4) Race or Ethnicity (6) sexual orientation (7) Association with a person or GROUP with one or more of these actual or perceived charachteristics" So even if brian wasnt gay he would still be protected because the attackers knew him from harrasing our whole group. You'd know that if a particular officer had put that in his initial report. ;) Sincerly Richard Shelby-Dunn

Chico is getting the reputation as the place to go to for Gay Bashing. Wake up Chico PD & DA Ramsey... your opinion doesn't count... let the definition of Hate Crime play out in court. The witnesses should count as evidence.

This so frustrating because its an obvious hate crime they came out of a drag show an what it would be different if it was someone dressed in drag please.... its probably even more so because he was sticking up for them an got sucker punched for it an because he was already down they went after him... I'd definitely fight it, its sad to see that there r people in our world that hate themselves so much they have to pick on others....
