An accused Chico murder suspect now heads to trial, after his attorney unsucessfully argued to restore his right to a preliminary hearing.
The new attorney for Jeffrey Menzies says his first attorney didn't provide adequate legal counsel for a potential death-penalty case.
Menzies is charged with the sniper-style murder of 26-year-old David Yang in 2011 , as Yang sat behind the wheel of his car at the intersection of Bruce Road and Highway 32.
Foster claims Menzies didn't knowingly waive his right to have a preliminary hearing.
But Judge James Reilley upheld the waiver following a hearing Wednesday, and the start of Menzies trial is scheduled for July eighth.###
