A Gridley man pleaded guilty Wednesday to felony charges in connection with a fatal hit and run near Durham.
Tony Mardesich sat quietly in front of the judge, speaking only to enter his guilty plea and answer questions.
The 71-year-old admitted to felony hit and run as well as felony insurance fraud during the ten minute hearing.
Mardesich's Attorney told Action News he panicked after hitting 61-year-old Rick Magee on the Midway on November 14th.
The farmer then told his insurance company that an oak branch had fallen onto his SUV. But later, he recanted that story after employees at a body shop noticed inconsistencies and reported them to the CHP.
The victim's family is hoping Mardesich is sentenced to the maximum of six years in prison. But, the actual sentence will be up to the Judge, and will be based on the recommendation of probation officers
The Defense says they have reached out to Magee's" family to express remorse and set up a meeting, but the family has politely declined.
Mardesich will remain free until his February sentencing, but was ordered not to drive.###
